Objectives of Sharia in Preserving Human Dignity Between Theory and Practice

This study proceeds from a foundational jurisprudential truth that Islamic Sharia has given human dignity utmost care, establishing it as a supreme value and a comprehensive objective under which rulings and legislations fall. The research problem lies in monitoring and tracking the widening gap between this solid theoretical grounding of dignity in maqasidic thought and the contemporary practical reality of human and Islamic societies, which witnesses blatant violations generated by wars, greedy economic systems, and political tyranny.
The research relied on the inductive approach to trace the legal evidence and jurisprudential rules harboring dignity, alongside the critical analytical approach to diagnose and critique the reality of contemporary crises in light of the maqasidic vision.
The research concluded with a number of key findings, most notably:
- Dignity in Islam is an inherent divine gift, universal in scope, immutable and non-negotiable, representing the governing and organizing umbrella for the five essentials (religion, life, intellect, progeny, and wealth).
- The defect and shortcoming do not lie in the legislative theory, but rather in the absence of mechanisms for the practical implementation of these objectives in daily life.
The research presented a set of practical recommendations and mechanisms to bridge this divide, represented by:
- The necessity of "constitutionalizing maqasid Sharia" and transforming them into binding, litigable legal texts (such as laws on minimum living wages and criminalizing torture).
- Activating independent institutional oversight and effective judiciary.
- Integrating maqasidic dignity values into educational curricula and media systems to build societal awareness that protects humans and preserves their humanity.
